The terms and conditions of these Terms of Use apply to your use of the Site and Services offered by the entity with whom you have contracted (hereinafter "KOCASE", "Our", "We" or "Us"). The Privacy Policy is an integral part of these Terms of Use. We operate internationally and provide services to our customers through various entities. Which entity you contract with depends on the region in which you are located. The table below describes the entity with which You contract. It shows that this entity provides you with all the services described below in the Terms of Service, you make payments to this entity, and it means that any complaints for improper performance of the service can only be made to this entity. These Terms of Use govern the relationship between KOCASE and any individual with full legal capacity according to the laws of their country or territory, which typically means being at least eighteen (18) years old ("User", "you", or "your") when using the Services and Website. Adolescents over the age of 14 may only use the Website and Services offered through an account established and supervised by a parent or a guardian. The parent or the guardian is solely responsible for supervision of activities of the persons under their wardship. All necessary personal details for account registration and transactions shall be for the name of the parent/guardian, unless you provide us with an authorization in the form allowed by the applicable legislation and accepted by us with expressly stated consent of the parents/guardians to allow otherwise. Such authorization can be refused to accept at our sole discretion. No person under fourteen (14) years of age is allowed to use the Services, even with parental or guardian consent. If the law of the country or territory where the individual lives requires a higher minimum age, that law will apply. It shall be our right to take all reasonable measures, which we, at our discretion, find necessary to verify the possibility of our Users to use the Website and Services, and whether we have any doubts we may request additional proofs or verifications. We reserve the right to terminate provision of the Service to any User who, at our discretion, shall have no right to use the Service. Please read these Terms of Use before using KOCASE's Website and Services. By registering (authorizing) on the Website, you accept these Terms of Use. If you do not agree with the Terms of Use, please do not use the Services and Website. By accessing or using our Website and Services, you agree to be bound by these Terms of Use and our Privacy Policy. Please be aware that the Items are virtual items intended for entertainment purposes only and so shall be used. Given Items have no real value, we do not compensate users any Items, nor we pay for them. Please be aware that notwithstanding the circumstances we do not exchange any Balance for real money, given it does not have any real value. The Balance exists only to use for Service and cannot be withdrawn, paid or compensated in any manner.
DEFINITIONS
Means all the rules included in the Terms of Use, outlining how to properly use the Website and Services.
Means a collection of web pages created using HTML, CSS, JavaScript, and other programming languages, accessible via the Internet at https://kocase.com, and managed by KOCASE.
Means an individual who has agreed to and accepted the Terms of Use provided by KOCASE.
Means a virtual in-game item, appearance or any other customization option that changes the appearance or reaction of corresponding in-game components (e.g., weapons, armors, accessories) supplied by the game publisher, KOG (Knight Online Global), under their policies and arrangements.
Means a secure section of the Website created upon User registration, which allows access to some or all functionalities of the Website.
Means the online role-playing game (MMORPG) developed and published by KOG, which owns all rights, including copyright to the game and its content, including all in-game items.
Means the corresponding rules and policies, adopted, accepted and enforced by KOG that set forth the rules applicable to in-game items.
Means any entity other than the User and KOCASE.
Means refers to both KOCASE and the User when mentioned together in these Terms of Use.
Means the services provided on the KOCASE platform allowing, in the form of interactive games, to obtain an Item. Each attempt to obtain an Item shall be considered as a separated Service. It is at our sole discretion to limit the specific form of the Services in the specific country or territory.
Means the interactive form of the Services that allows Users to open cases and receive one of the Items from those which are predetermined and indicated in the Case description.
Means the Website credits (visualized as special characters) on the Website, which can be used by Users to receive the Services. Topping up the Balance shall not be deemed as a provision of the Service until the Balance is used for a corresponding Service.
Means the process of creating a KOCASE account to log in to the Website and access its Services.
Means the payment options currently supported by KOCASE. Users can select any available payment methods on the Website.
Means email messages containing information about promotions, events, giveaways, products/services, personalized offers and news.
Means email messages necessary to provide the Services and perform the agreement with the User: confirmations, receipts, security and access notifications, technical/legal updates to terms, information on transaction/subscription/balance status, and other mandatory notices.
GENERAL TERMS
By creating a KOCASE account and using KOCASE's Services and Website, you agree to be bound by the Terms of Use and Privacy Policy outlined below. Together, these documents form a legally binding agreement between you and KOCASE (the "Agreement"). Using KOCASE's Services and Website indicates your acceptance of these Terms of Use and Privacy Policy. If you disagree with any part of this Agreement, do not create an account or use KOCASE's Services and Website. Please read the Terms of Use and Privacy Policy carefully before proceeding. KOCASE may update or modify the Agreement from time to time, with any changes posted on the KOCASE Website. By continuing to use the Services and Website, you agree to the updated terms. You are responsible for regularly reviewing these Terms of Use to stay informed of any changes. The Website and Services may be used by a User who has full legal capacity under the laws of the country or territory where such person resides, which generally means the person must be at least eighteen (18) years old. A User under the age of legal capacity may use the Services and Website if authorization from the User's parents or guardians is provided in the manner stipulated hereinabove. However, no individual under the age of fourteen (14) may use the Service, even with parental or guardian consent. As a condition of using the Services, you agree not to: • Impersonate or misrepresent your affiliation with any person or entity; • Access, tamper with, or use any non-public areas of the Services or KOCASE's computer systems; • Attempt to probe, scan, or test the vulnerability of the Services or any related system or network; • Attempt to decipher, decompile, disassemble, reverse engineer or otherwise investigate any of the software or components used to provide the Services; • Harm or threaten to harm other users in any way or interfere with the access of any user, host or network; • Provide payment information belonging to a Third Party; • Systematically retrieve data or other content from the Services to create or compile a collection, compilation, database, or directory; • Make use of the Services in a manner contrary to the terms and conditions under which Third Parties provide facilities and technology necessary for the operation of the Services; • Infringe Third Party intellectual property rights of any kind when using or accessing the Services; • Engage in any fraudulent or illegal activities, including money laundering or financing of terrorism. At our discretion we may indicate the minimum Balance which shall be topped up before using the Service in full functionality, however such minimum Balance shall not exceed the equivalent of 2 USD per single transaction. Due to the nature of the Services, by topping up your Balance and using it to obtain the Service, you waive your right to withdraw. However, this right and any associated refunds may be available if required by applicable law.
ACCOUNT
ACCOUNT REGISTRATION: To create an Account and to gain access to the Services, please follow these requirements: 1. Account Creation — The User must register an account on the KOCASE website. 2. Acceptance of Terms — The User shall read and accept the Terms of Use and Privacy Policy and certify all consents indicated therein. 3. Sign-In — The User must sign in to KOCASE's Website using their credentials. BLOCKING: KOCASE may block an Account and restrict access to Services immediately, without prior notice or liability, if the User breaches these Terms of Use. We will suspend and/or terminate any Account if it is found that the User has provided false, misleading, or incomplete information during registration or any other interaction with the Website. KOCASE will immediately block an Account and restrict access to Services if the User impersonates KOCASE staff members (e.g., using names like "administrator" or "moderator"). Using multiple accounts for any purpose on the Services is strictly prohibited and may result in the termination of all accounts without notice. Any inactive Account, i.e. the Account which hasn't been used to purchase the Services within one calendar year from the last time the Services were purchased by a User, can be charged from the Balance with a maintenance cost in amount equal to 10 USD per month. Using offensive language or behaving disrespectfully in communication with a Support agent is not allowed and may result in termination without notice. RESPONSIBILITIES OF USER: By registering on the Website, the User agrees to take full responsibility for all actions taken under their username and password. If the User suspects any unauthorized access or theft of personal information, including account credentials, they must immediately notify KOCASE. By accepting these Terms of Use, the User agrees to use their Account for personal purposes only and not to transfer it to anyone else.
SERVICES OF KOCASE
GENERAL: KOCASE provides a Website through which Users may use Services provided on the Website. These Terms of Use are applied to all of the Services; however, some specific Services may have their own specific rules and procedures. CASES: KOCASE provides Users with the opportunity to purchase and open Cases on the Website, thus offering them the possibility to obtain Items. Users receive an Item when opening a Case. A Case contains a predetermined type of Items. The chance to obtain each Item is indicated therein and Users are encouraged to review the selection of Items available in Cases before purchasing, understanding that the specific Item received is determined randomly, unless otherwise stated. WITHDRAWALS AND TRADE REVERSAL RESTRICTIONS: Once an Item has been transferred from the Website to the User's account, KOCASE is not responsible for any cancellation, reversal, rollback, return, hold, restriction, delay, or recovery action affecting such transfer. In such cases, KOCASE does not guarantee return of the Item, repeated delivery, or any refund of any kind. BALANCE: Users who top up their Balance on the Website agree that the credits they receive are internal credits with limited usability. These credits can only be used for Services offered on the Website and have no real-world monetary value, and are non-refundable. Any refunds of the Balance can be made only strictly in accordance with the applicable legislation.
PAYMENT POLICY
GENERAL: To use the Services on the Website and top up the Account Balance, Users can choose from a variety of Payment Methods. A list of available Payment Methods can be found on the payment page of the respective Services. Each Payment Method has its own terms and policies, including AML (Anti-Money Laundering) and KYC (Know Your Customer) requirements, and may reject or suspend transactions based on their rules. Users must review and accept the terms and policies of the chosen Payment Method before proceeding with any transactions. KOCASE is not responsible for any delays in payment and the actions of the applicable Payment Method. Users must ensure they are the legal owner of all bank accounts, cards, and other payment accounts used for transactions. SECURITY: KOCASE prioritizes the security of Users' payment information and uses industry-standard SSL 256-Bit RSA encryption technologies and secure payment gateways. KOCASE does not store full payment card details on its servers. CHARGEBACKS AND FRAUDULENT ACTIVITY: If KOCASE detects suspicious or unauthorized transactions, including improper use of the chargeback procedure, we reserve the right to temporarily suspend or block the user's account and take legal action to recover any incurred losses. Users agree not to initiate any chargebacks without first attempting to resolve the issue with KOCASE's Support team.
REFUNDS AND RETURNS
Due to the nature of Items and their immediate delivery, KOCASE generally does not offer refunds or returns once the Service is provided. However, in exceptional circumstances, such as technical errors or duplicate purchases, KOCASE may consider refund requests on a case-by-case basis. Users who believe they are eligible for a refund can contact KOCASE Support, providing relevant information and evidence in advance. Any approved refunds will be issued using the original payment method whenever possible. Items received by the User will be automatically converted to credits and added back to the User's Account balance if not used within 30 (thirty) days of receipt.
AML AND KYC POLICY
KOCASE is committed to providing a safe and secure Website and Services that comply with Anti-Money Laundering (AML) and Know-Your-Customer (KYC) regulations. This section outlines our approach to preventing money laundering, terrorist financing, and conducting due diligence on our Users. KOCASE reserves the right to refuse service or limit access to any User who fails to comply with AML and KYC requirements. USER DUE DILIGENCE: KOCASE conducts thorough user due diligence during account registration. Users must provide accurate information, including first and last name, address, date of birth, billing address, and other necessary identification details. KOCASE will continually monitor User transactions and Account activity to identify and report suspicious behavior. Both automated systems and manual reviews are used to detect potential suspicious activities. NON-COMPLIANCE CONSEQUENCES: If a User does not comply with this AML/KYC policy or applicable laws, we may block the User's Account, initiate additional KYC procedures, freeze the User's Balance, or pursue other disciplinary actions or legal consequences.
INTELLECTUAL PROPERTY
The Website, Services, and all their content including, but not limited to: text, software, scripts, code, design, graphics, photos, sounds, music, videos, applications, interactive features, articles, news, logos, slogans, designs, domain names, fonts, and other content is the property of KOCASE or others from whom we license or otherwise legally access such Content and is protected by copyright, trademark, patent and other laws. You are not allowed to engage in activities such as copying, imitating, selling, licensing, reverse engineering, reproducing, publicly performing, publishing, transmitting, displaying, adapting, editing, decompiling, or creating derivative works from any of KOCASE's intellectual property. KOCASE retains all rights to this content. By accessing or using our Website or Services, you do not gain any license or ownership rights in these intellectual properties.
AFFILIATION
KOCASE is an independent platform and is NOT affiliated with, endorsed by, or sponsored by KOG (Knight Online Global), GamersFirst, or any other game publisher or platform. All trademarks, service marks, and game content belong to their respective owners. The Website operates exclusively as a case-opening service, allowing Users to purchase and open digital Cases that contain virtual Items associated with Knight Online. These Items are selected randomly and exist solely for use within the game. All references to Knight Online, KOG, or any in-game content are for descriptive purposes only, in order to clarify the functionality of the Items. KOCASE emphasizes that it has no control over or influence on Knight Online's operations, rules, restrictions, or policies. All trademarks and service marks belong to their respective owners.
APPLICABLE LAW AND JURISDICTION
These Terms of Use, and any dispute, claim and all inquiries relating to the construction, validity, enforcement, and interpretation arising out of or in connection with it or its subject matter or formation, shall be governed by, and construed in accordance with, the laws of Singapore. In the event of a dispute, the user must file a claim with KOCASE, which must detail the nature and basis of the dispute. If the claim is not settled within 30 days, the parties may refer the dispute to the courts. In the case of any contradictions between the language versions of these Terms of Use, the English one shall prevail.
LIMITATION OF LIABILITY
KOCASE's Services may contain links to Third Party websites or services that are not owned or controlled by KOCASE. KOCASE has no control over and assumes no responsibility for the content, privacy policies, or practices of any Third Party Website or Services. You further acknowledge and agree that KOCASE will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
WARRANTY DISCLAIMERS
THIS WEBSITE AND THE SERVICES ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE WEBSITE OR SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. Please make sure you review the modified Terms because if you continue to use the Website and/or Services after KOCASE has posted modified Terms of Use, you agree to be bound by the modified Terms of Use. Because the Website and Services are evolving over time, we may change or discontinue all or any part of the Website and/or Services, at any time and without notice, at KOCASE sole discretion.

KOCASE provides support to Users via the F.A.Q available at https://kocase.com/faq or via our Support Team at https://kocase.com/support. F.A.Q. sections of specific service shall be considered as the additional clarification of these Terms of Use. If any discrepancies between the F.A.Q. section and these Terms of Use appear, the latter shall prevail.
